Madras HC refuses to direct NCLT to take up Sivaganga MP’s plea
Chennai: Madras high court has refused to direct National Company Law Tribunal (NCLT), Chennai, to expeditiously dispose of an application moved by Sivaganga MP Karti P Chidambaram to free his personal salary account that was frozen by the serious fraud investigation office (SFIO).A division bench of Justice S M Subramaniam and Justice K Surender passed the order saying, "Only in exceptional circumstances, where courts form an opinion for expeditious disposal of the cases, are terms and conditions to be stipulated. In normal circumstances, such direction would result in unnecessary burden to the courts concerned."In the present case, the petitioner filed an application only on April 8 before the tribunal. The present writ petition was instituted on April 9, the very next day, the court pointed out.One party approaching the HC for speedy disposal may cause prejudice to the interest of other litigants waiting for disposal of their cases. however high the litigants are, all must be treated equally when the cases are dealt with by the courts, the judges added.
